Leaves of Absence

When employees are absent from work for more than a week (other than for a preplanned vacation), they could be eligible for a leave of absence.

At least 30 days prior to the anticipated leave start date, the employee should complete and sign the appropriate leave application form and submit it to his/her supervisor. Once signed by the supervisor, the application form should be forwarded to Benefits Administration at SP211 at least two weeks prior to the leave start date except in cases of a bona fide emergency.

If the leave is unforeseen, the employee's supervisor and Benefits Administration should be notified of the extended absence as soon as possible and the appropriate forms will be mailed.

Types of Leave

Family Medical Leave - Employee Serious Health Condition

Employees with at least one year of service (and 1,250 hours worked over the previous 12 months) may be eligible for up to 12 weeks of unpaid, job-protected leave with benefits for a serious health condition that makes the employee unable to perform their job. This type of leave is protected under the Federal Family Medical Leave Act (FMLA) and the California Family Rights Act (CFRA) which run concurrently in this situation.

Family Medical Leave - Family Member Serious Health Condition

Employees with at least one year of service (and 1,250 hours worked over the previous 12 months) may be eligible for up to 12 weeks of unpaid, job-protected leave with benefits to care for their spouse, domestic partner, son or daughter, or parent who has a serious health condition. This type of leave is protected under the Federal Family Medical Leave Act (FMLA) and the California Family Rights Act (CFRA) which run concurrently in this situation.

Family Medical Leave - Maternity or Adoption

Employees with at least one year of service (and 1,250 hours worked over the previous 12 months) may be eligible for up to 12 weeks of unpaid, job-protected leave with benefits to give birth and/or care for their child after birth, or for adoption or foster care placement. This type of leave is protected under the Federal Family Medical Leave Act (FMLA) and/or the California Family Rights Act (CFRA). When the employee resides in California and the leave of absence is for the purposes of giving birth and caring for the baby afterwards, the FMLA and CFRA do not run concurrently but may overlap. FMLA Leave starts from the first day off and runs for twelve weeks. CFRA Leave runs twelve weeks from the day the mother is no longer disabled from pregnancy/birth and can be used for bonding time with the newborn. In any maternity situation, benefits will be continued for only the first 12 weeks of leave.

Pregnancy Disability Leave - California Employees

Employees may be eligible for up to 4 months of unpaid, job-protected leave with benefits for a disability related to pregnancy and/or birth, regardless of their length of service with TSRI. This type of leave is protected under the California Pregnancy Disability Leave Act (PDL) and runs concurrently with Family Medical Leave Act (FMLA) Leave if the employee is eligible for both.

Personal Leave

TSRI may allow employees the opportunity to take time off for personal reasons. Personal leaves of absence are discretionary based on the sole and exclusive judgment of TSRI. The employee’s supervisor will evaluate the needs of the lab/department/unit and make a determination if an employee’s request for personal leave can be accommodated.
